This website is operated by ABC Dress Hire. Throughout the site, the terms “we”, “us” and “our” refer to ABC Dress Hire. ABC Dress Hire offers this website, including all information, tools, products, garment hire services and related services available from this site to you, the user, conditional upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our website, placing a booking, hiring a garment, purchasing a product or service, or otherwise using our website, you engage in our “Service” and agree to be bound by these Terms of Service, including any additional terms, conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including, without limitation, browsers, customers, merchants, vendors and contributors of content.
Please read these Terms of Service carefully before accessing or using our website or placing a booking. By accessing or using any part of the site, or by making a booking with ABC Dress Hire, you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions of this agreement, you must not access the website, place a booking, hire a garment or use our Services.
Any new features, garments, products, services or tools added to the current store will also be subject to these Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of, or access to, the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. Shopify provides us with the online e-commerce platform that allows us to offer our products and Services to you.
Section 1 — Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, territory or province of residence, or that you are the age of majority in your state, territory or province of residence and you have given us your consent to allow any of your minor dependants to use this site.
You must not use our products or Services for any illegal or unauthorised purpose. You must not, in your use of the Service, violate any laws in your jurisdiction, including but not limited to copyright laws.
You must not transmit any worms, viruses, malware or any code of a destructive or harmful nature.
A breach or violation of any of these Terms may result in immediate termination of your access to our Services and may result in cancellation of your booking.
Section 2 — General Conditions
We reserve the right to refuse Service to anyone for any reason at any time, subject to applicable law.
You understand that your content, not including credit card information, may be transferred unencrypted and may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, access to the Service, or any contact on the website through which the Service is provided, without our express written permission.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
Section 3 — Hire Periods and Booking Timeframes
ABC Dress Hire offers standard garment hire periods of four (4) days or eight (8) days, unless otherwise agreed by us in writing.
The hire period begins on the date selected by you for the garment to arrive or be made available to you. You are responsible for selecting a hire period that allows sufficient time for delivery, use and return of the garment.
A four (4) day hire period is our base hire period and base hire price for each garment. If you return a garment before the end of the four (4) day hire period, you will not be entitled to a refund, partial refund or credit for unused hire days.
An eight (8) day hire period is recommended where you are travelling, attending multiple occasions during the hire period, live in a rural or remote area, or otherwise require additional time.
If you live in a rural or remote area, you must notify us before placing your booking so that we can assess whether additional delivery time is required. We are not responsible for delays caused by your failure to notify us of rural, remote or difficult delivery requirements.
If you require a hire period longer than eight (8) days, including for travel bundles or extended bookings, you must contact us directly before placing your order. Extended hire periods are subject to garment availability and approval by ABC Dress Hire.
Items are not secured for your booking unless and until full payment has been received by us.
Section 4 — Postage and Delivery
We ship Australia wide using express postage services. Estimated delivery is generally between one (1) and four (4) business days, depending on your location and postal service conditions.
You will receive tracking information once your order has been fulfilled and dispatched. It is your responsibility to monitor your tracking information and contact us promptly if your parcel appears delayed or if there are delivery issues.
An order will generally be considered delayed if it has not been delivered within four (4) business days from the date it was posted. For rural or remote locations, an order will generally be considered delayed if it has not been delivered within five (5) business days from the date it was posted.
If your order does not arrive within the relevant timeframe, you must contact us promptly. You may be eligible for a store credit or rescheduling of your hire, subject to these Terms and at our discretion. Postage costs are not refundable and may be deducted from any store credit issued.
We take national public holidays into account before dispatching orders. If we believe your order may not arrive in time due to a public holiday or other known delivery risk, we may contact you before dispatch to confirm whether you wish to proceed and accept the risk of potential delays.
Once a parcel has been dispatched, delivery is handled by the relevant postal or courier provider. Postal and courier delays are outside our control.
Section 5 — Postal Delays
In the event that your hire is delayed in transit, we sincerely apologise for the inconvenience. However, postal delays are outside the control of ABC Dress Hire.
If your item does not arrive in time for your event, we may offer a store credit or reschedule your hire to a future date, subject to garment availability and these Terms.
Refunds are not provided for delayed parcels where the delay was caused by the postal or courier provider and the order was dispatched by us within a reasonable timeframe. Postage costs are not refundable.
If your item arrives late but is still worn or used by you, no refund, store credit or compensation will be issued under any circumstances.
If your parcel appears delayed, you should avoid requesting a redirection, as redirection may significantly extend delivery times. Any delay caused or increased by a redirection request made by you will be your responsibility.
Last minute bookings are subject to the specific terms set out in Section 6 below.
We ask that all communication with our team remains respectful. Abusive, threatening, aggressive or inappropriate behaviour will not be tolerated and may result in refusal of future Service.
Section 6 — Last Minute Bookings
Bookings made within four (4) business days of your hire start date are considered last minute bookings.
If you choose to proceed with a last minute booking and your garment does not arrive in time, or cannot be fulfilled in time for your event, you will not be eligible for a refund or store credit.
Our team will use reasonable efforts to notify you if we believe your order may not be suitable for your timeframe. However, if you choose to proceed, you acknowledge and accept the risk that the garment may not arrive or be available in time.
ABC Dress Hire will not be held responsible for last minute bookings that do not arrive or cannot be fulfilled in time for your event.
Section 7 — Security Deposits
A security deposit may be automatically applied to your cart at checkout. This amount cannot be removed from your order. However, unless otherwise stated, the security deposit is not charged upfront at checkout.
The security deposit is held as a safeguard against significant damage, late return, loss, failure to return, or other breach of these Terms.
If your hire is returned on time and in good condition, the security deposit will not be charged.
If significant damage occurs, the security deposit may be charged and applied towards specialist cleaning, repair or other costs incurred by us. If the cost of cleaning, repair, replacement or recovery exceeds the security deposit, you will be liable for the additional amount.
Where additional charges apply, we will use reasonable efforts to provide an invoice or cost breakdown for transparency.
We reserve the right to charge the card on file or seek payment from you for any unpaid amounts arising from damage, late fees, replacement costs, cleaning costs, debt recovery costs or other charges payable under these Terms.
Section 8 — Backup Dress Option
ABC Dress Hire may offer a backup dress option at checkout or by promotional code. Where available, you may select an alternative style or the same design in a different size and pay a reduced backup dress fee, currently thirty percent (30%) of the hire price for the second garment.
Orders using the BACKUPDRESS code must have both garments booked for the same hire dates.
The backup dress fee is non-refundable.
You may wear only one (1) of the two garments to your event. If both garments are worn, you will be charged the full hire fee for the backup garment, less any backup dress fee already paid.
If you choose to wear either the full-priced garment or the backup garment, no price difference will be refunded.
If the tag is removed from the backup garment, the full hire fee for that garment will apply.
To add a backup dress, you must add both garments to your cart for the same hire date, enter the BACKUPDRESS code at checkout, and complete your order. The backup dress option is subject to availability and may be amended or withdrawn at any time.
Section 9 — Incorrect or Faulty Items
If you receive an incorrect item, you must email us immediately at info@abcdresshire.com. Where there is sufficient time and availability, we will use reasonable efforts to arrange a replacement item.
If you receive the correct item but believe it has damage, faults, noticeable stains or another issue, you must notify us within six (6) hours of receiving the item and before wearing or using the item.
You must notify us within this timeframe even if you still intend to wear the garment. Failure to notify us may affect your eligibility for any remedy and may result in you being held responsible for the damage.
If you do not notify us within six (6) hours of receiving the item and before wearing it, we reserve the right to refuse a refund, store credit or other remedy, as it may not be possible to determine when or by whom the damage occurred.
If we advise that a refund, store credit or assessment may be considered upon return, you must post the item back within one (1) business day, unless otherwise agreed by ABC Dress Hire in writing.
You acknowledge that hire garments are not brand new and may show reasonable signs of prior wear and tear. A refund or credit may not be granted where the issue is minor, insignificant, consistent with ordinary hire wear, or does not prevent reasonable use of the garment.
Section 10 — Sizing, Fit and Style Issues
We use reasonable efforts to provide sizing information, garment details and fit guidance. However, body shapes, personal preferences, garment cuts and sizing standards vary.
We do not offer refunds where a garment does not fit as expected, does not suit you, or you change your mind about the style.
If your garment does not fit, we may assist with an exchange for an alternative style where possible. Any exchange is subject to garment availability, timing and delivery feasibility. We cannot guarantee that a replacement will arrive in time for your event.
You must not force a garment to fit if it feels too small or tight, as this may damage the fabric, seams or zipper. All garments and zips are inspected before dispatch. Damage caused by forcing a garment to fit, including zipper breakage, is not covered by Accidental Damage Protection and will be your responsibility.
All garments are professionally steamed prior to dispatch. Minor creasing may occur during transit. If your garment arrives lightly creased, do not iron it. You may use a garment steamer on a low heat setting or hang the garment in a steamy bathroom to allow the fabric to relax. If creasing persists, contact us for guidance.
Section 11 — Cleaning and Garment Care
All garments are professionally dry cleaned by ABC Dress Hire. You are not required to clean the garment before returning it.
You must not attempt to clean, wash, dry clean, spot treat, iron, bleach, soak, tumble dry, alter, hem, pin, tape, glue, modify or repair the garment yourself.
Any unauthorised cleaning, treatment, alteration or modification may cause damage and may result in cleaning, repair or replacement fees being charged to you.
You must return the item after your event in accordance with these Terms. ABC Dress Hire will arrange standard professional cleaning after return.
Section 12 — Fake Tan, Perfume, Makeup and Staining
You must take reasonable care when wearing makeup, body makeup, fake tan, perfume, oils, lotions or similar products while using our garments.
These products can transfer onto fabric and may cause staining, discolouration, odour or other damage requiring specialist cleaning or repair at your expense.
If wearing fake tan, you must ensure it has been thoroughly washed off before wearing the garment. Unwashed or developing tan may cause permanent discolouration to delicate fabrics.
You must not spray perfume directly onto the garment, as this may leave lasting marks, odours or fabric damage.
You will be responsible for specialist cleaning, repair or replacement costs arising from staining, discolouration, odour or damage caused by makeup, fake tan, perfume or similar products.
Section 13 — Accidental Damage Protection
ABC Dress Hire may offer optional Accidental Damage Protection at checkout for an additional fee, currently $10 per garment.
Accidental Damage Protection provides limited coverage for minor accidental damage, including up to $50 worth of specialist cleaning or seamstress repairs for a single garment, subject to a maximum total coverage of $200 in repair or replacement fees for the relevant order.
If the cost of repair or specialist cleaning exceeds the applicable coverage amount, you will be required to pay the remaining balance.
Accidental Damage Protection may cover minor accidental tears or rips, missing or broken jewels or diamantes, and stains that can be successfully removed through specialist cleaning.
Accidental Damage Protection does not cover lost or stolen items after delivery, returns lost or stolen in transit, deliberate damage, careless damage, damage caused by misuse, damage beyond repair, stains that cannot be removed, damage to zips, or items requiring full replacement.
If an item is returned in a condition deemed by us or our repair provider to be beyond repair and replacement is required, Accidental Damage Protection will not apply and cannot be claimed.
Accidental Damage Protection must be selected and paid for at checkout. It cannot be added after the garment has been dispatched or after damage has occurred.
Section 14 — Damage, Loss and Replacement
When hiring our garments, you are expected to treat them with the utmost care and respect.
You must contact us immediately if a garment is damaged, stained, lost, stolen, altered or otherwise affected in any way.
You are liable for all repair, specialist cleaning, restoration or replacement costs arising from damage, loss, theft, misuse, neglect, failure to follow care instructions, unauthorised alteration or breach of these Terms.
If a garment is damaged but repairable, you will be charged the cost of repair and any related specialist cleaning or restoration costs.
If a garment is deemed by us, a seamstress, dry cleaner, supplier or repair provider to be non repairable, you will be charged the replacement value of the garment. You will not be entitled to keep possession of the damaged garment unless expressly agreed by us in writing.
You will have twenty-one (21) days from the date an invoice is issued to pay for the replacement of an item deemed non-repairable, lost, stolen, wrongfully retained or otherwise not returned. If the invoice remains unpaid after twenty-one (21) days, the matter may be referred to a debt collection agency or other recovery process. Any additional costs incurred as a result of debt recovery, including debt collection fees, administrative costs, legal fees or associated recovery expenses, will be your responsibility.
We reserve the right to charge the card on file for any unpaid damage, cleaning, repair, replacement, late return, non-return, stolen item, debt collection fee or any associated costs incurred in recovering amounts owed under these Terms and Conditions.
Section 15 — Late Returns
For postal returns, garments must be lodged over the counter at Australia Post by 4:00 pm on the final day of your hire period, unless otherwise agreed by us in writing.
If your return is not posted, lodged or dropped back by the required time, late fees will apply.
If a parcel is awaiting collection by you and remains uncollected, late fees will be charged for each day the item is not collected and returned.
Late returns can affect other customer bookings. To ensure fairness, a late fee of $39 per day will be charged for each day the item remains unreturned beyond the due date.
Invoices issued for late fees must be paid within twenty one (21) days. If an invoice remains unpaid after this period, it may be referred to a debt collection agency for recovery.
We reserve the right to charge the card on file at any time for outstanding late fees or related charges.
You must contact us as soon as possible if you believe your return will be late.
Section 16 — In Home Try On Requests
ABC Dress Hire may offer an in home try on service, subject to availability and approval.
Under this service, a selected garment may be delivered to you for a 24 hour try on period, timed from signature upon delivery or confirmed delivery time.
The in home try on fee is generally between $50 and $100, depending on the garment, plus express postage, currently $26. Fees may vary and will be confirmed by us before the try on is approved.
If you decide not to proceed with a hire after your try on, the try on fee is non refundable.
If you proceed with a hire, fifty percent (50%) of the try on fee, excluding postage costs, may be credited towards your booking. To redeem this credit, the dress must be booked within 48 hours of the try on arrives. Any unused try on credit will automatically expire after this period.
To request an in home try on, you must contact us at info@abcdresshire.com and provide the garment requested, your size and your event date.
In home try ons are subject to garment availability and may not be available for all garments, dates or locations.
The garment must be returned over the counter at Australia Post within 24 hours after delivery, or earlier. If the garment is not returned within this timeframe, you may be charged the full hire price.
If the garment is returned with makeup, fake tan, perfume marks, stains, tears, odour, damage or other issues, you will be liable for any cleaning, repair or replacement costs.
Section 17 — Change of Mind and Cancellations
For change of mind cancellations, a store credit may be offered where at least fourteen (14) days notice is provided prior to the booking start date.
If a cancellation request is made less than fourteen (14) days before the booking start date, the booking will be forfeited and is not eligible for a refund or store credit.
Any request to cancel within fourteen (14) days of the booking start date must be communicated to us immediately and remains subject to our approval and discretion.
Once a store credit has been issued, it is final and cannot be reversed, refunded, transferred or exchanged for cash.
Section 18 — Store Credits and Refunds
Store credits are valid for 1 year from the date of issue, unless otherwise stated in writing.
All policies in these Terms apply to bookings made using store credit.
If an order placed using store credit is cancelled and we approve the cancellation, the store credit may be reissued for the same value, subject to these Terms.
Store credits are strictly non refundable. Once issued, a store credit is final and cannot be reversed, refunded or exchanged for a monetary refund under any circumstances, including change of mind.
Refunds are not provided for cancellations made within fourteen (14) days of the booking start date, except where required by law.
Refunds will only be considered where the item received is faulty, or where the item arrives late and you are unable to wear it to your event, subject always to these Terms and applicable law.
If an item arrives late but is still worn or used, no refund or store credit will be issued under any circumstances.
If your order is dispatched on time but delivery is delayed due to the postal or courier service, the delay is beyond our control and does not constitute a fault by ABC Dress Hire. In such circumstances, a refund will not be issued, although a store credit may be provided at our discretion, provided the item has not been worn.
By placing a booking, you acknowledge and agree to this policy.
Section 19 — Sale Items and Discount Codes
Items hired using a discount code, promotional code or during a sale period are not eligible for a refund.
This includes, without limitation, promotions such as Black Friday, Cyber Monday, EOFY sales, Boxing Day sales and other discount campaigns.
In the event of inconvenience, booking delay or other approved issue relating to a discounted or sale booking, a store credit may be issued at our discretion.
Section 20 — Verification and Fraud Prevention
In some cases, we may require you to verify your identity by providing valid identification, such as a driver licence, passport, student identification or other documentation reasonably requested by us.
Identity verification may be required to prevent fraud, protect our garments, verify booking details or comply with risk management processes.
If you are unable or unwilling to provide requested verification details, your order may be cancelled. Where applicable, any refund, store credit or cancellation outcome will be determined in accordance with these Terms.
Section 21 — Payment
Items are not secured unless full payment has been made and received by ABC Dress Hire.
Afterpay may be available for online bookings only, subject to Afterpay’s own terms and approval processes.
Cash may be accepted where expressly agreed by ABC Dress Hire.
You authorise us to charge or seek payment from you for any amounts payable under these Terms, including hire fees, late fees, security deposits, cleaning fees, repair fees, replacement costs, postage costs and debt recovery costs.
Section 22 — Request a Garment
You may email us at info@abcdresshire.com to request that we source or add a garment to our collection.
Your request should include the brand name, style name or link if available, requested size and event date.
While we welcome suggestions, we are under no obligation to approve, source, purchase or stock any requested garment.
Section 23 - New Zealand International Postage
New Zealand postage does not include return postage. The borrower is fully responsible for arranging and covering the cost of return postage. All returns must be sent using a tracked express postage service. A return tracking number must be provided to ABC Dress Hire once the item has been lodged for return.
The borrower understands they are fully liable for any issues caused by shipping the item to an incorrect address, failing to provide a valid tracking number, or failing to properly lodge the parcel with the postal carrier.
The borrower also acknowledges that if the item is not posted back on the end date of the hire period, late fees will apply. The tracking information and/or lodgement receipt will be used as proof of the return date. For example, if the item is due to be returned on Monday but the tracking shows it was not posted until Wednesday, this will be considered a late return and late fees will be charged accordingly.
A shipping label being created does not constitute the item being posted. The parcel must be physically lodged with the postal carrier and show an acceptance scan/tracking update by the return due date. Proof of lodgement must clearly display the date the parcel was posted. If no valid proof of lodgement can be provided, ABC Dress Hire reserves the right to treat the item as returned late.
Late fees will continue to accrue until the item has been lodged correctly and is showing as in transit via tracking, or until the item has been successfully returned to ABC Dress Hire. Weekends, public holidays, customs delays, postage delays, or courier delays do not waive late fees where the item was lodged after the required return date, unless otherwise agreed in writing by ABC Dress Hire.
It is essential that items are posted back on time, as late returns can impact other customers bookings.
ABC Dress Hire uses Australia Post International Express for all New Zealand orders. Australia Post currently advises an estimated delivery timeframe of 7–14 business days for this service. ABC Dress Hire takes no responsibility for postage delays, courier delays, customs hold ups, or any other shipping delays once the item has been dispatched.
The borrower remains fully responsible for the garment until it has been successfully delivered back to ABC Dress Hire. We strongly recommend purchasing additional postal cover or insurance for international returns, as the borrower is liable for any loss, theft, or damage occurring during return transit.
Any additional customs duties, import taxes, or fees associated with the shipment are the sole responsibility of the borrower.
ABC Dress Hire reserves the right to request proof of identification from the borrower at any time prior to dispatch or during the hire process for security and verification purposes.
Section 24 — Products or Services
Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return, exchange, store credit or refund only in accordance with these Terms and our Refund Policy.
We have made every effort to display as accurately as possible the colours and images of our products and garments. We cannot guarantee that your computer, phone or device display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sale, hire or provision of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.
We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products, garments, hire pricing or product pricing are subject to change at any time without notice, at our sole discretion.
We reserve the right to discontinue any product, garment or Service at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information or other material purchased, hired or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
Section 25 — Accuracy of Billing and Account Information
We reserve the right to refuse any order or booking you place with us. We may, in our sole discretion, limit or cancel quantities hired or purchased per person, per household or per order.
These restrictions may include orders placed by or under the same customer account, the same credit card, or orders using the same billing, shipping or delivery address.
If we make a change to or cancel an order, we may attempt to notify you by contacting the email address, billing address or phone number provided at the time the order was made.
We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, competitors or distributors.
You agree to provide current, complete and accurate purchase, booking and account information for all purchases and bookings made through our store. You agree to promptly update your account and other information, including your email address, phone number, billing information and payment details, so that we can complete your transactions and contact you as needed.
Section 26 — Accuracy, Completeness and Timeliness of Information
We are not responsible if information made available on this site is not accurate, complete or current, except where required by law.
The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.
Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information is not current and is provided for reference only.
We reserve the right to modify the contents of this site at any time, but we have no obligation to update information on our site, except as required by law. You agree that it is your responsibility to monitor changes to our site.
Section 27 — Modifications to the Service and Prices
Prices for our products, hire services, postage, deposits and additional services are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service, or any part or content thereof, without notice.
We shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service, except where required by law.
Section 28 — Optional Tools
We may provide you with access to third-party tools over which we neither monitor nor have any control or input.
You acknowledge and agree that we provide access to such tools “as is” and “as available”, without any warranties, representations or conditions of any kind and without any endorsement.
We shall have no liability arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which such tools are provided by the relevant third-party provider.
We may also, in the future, offer new Services and/or features through the website, including new tools and resources. Such new features and/or Services will also be subject to these Terms of Service.
Section 29 — Third-Party Links
Certain content, products and Services available via our Service may include materials from third parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we do not warrant and will not have liability or responsibility for any third-party materials, websites, products or Services.
We are not liable for harm or damages related to the purchase or use of goods, Services, resources, content or any other transactions made in connection with third-party websites.
Please review third-party policies and practices carefully and ensure you understand them before engaging in any transaction. Complaints, claims, concerns or questions regarding third-party products should be directed to the relevant third party.
Section 30 — User Comments, Feedback and Other Submissions
If, at our request, you send specific submissions, such as contest entries, or without a request from us you send creative ideas, suggestions, proposals, plans or other materials, whether online, by email, by postal mail or otherwise, collectively “comments”, you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.
We are and shall be under no obligation to maintain comments in confidence, pay compensation for comments or respond to comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable, or that violates any party’s intellectual property rights or these Terms.
You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary rights.
